Welcome to Noir Cigar™. By accessing or using noircigar.com, the Detective's Case File application (journal.noircigar.com), or any associated Noir Cigar™ service, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not use our services.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and AC Creative, Inc. ("we," "us," "our," or "The Agency"). By accessing or using our services in any manner, you represent that you have read, understood, and agree to be bound by these Terms; that you are of legal age in your jurisdiction (at minimum 21 years of age in the United States); and that you are not prohibited by any applicable law from using our services.
We reserve the right to update or modify these Terms at any time. Your continued use of our services after notice of changes constitutes acceptance of the modified Terms.
You must be of legal tobacco consumption age in your jurisdiction to use Noir Cigar™ services. In the United States, this means you must be at least 21 years of age. By using our services, you represent and warrant that you meet this age requirement.
Tobacco Health Disclaimer: Cigar smoking involves serious health risks, including but not limited to lung cancer, heart disease, and nicotine dependence. Noir Cigar™ does not endorse or minimize these risks. All cigar-related content is provided for informational and entertainment purposes for adult audiences only.
Noir Cigar™ does not sell, ship, or fulfill tobacco products directly. All purchase transactions are completed on third-party affiliate retailer websites and are subject to those retailers' own terms, age verification requirements, and applicable state and local tobacco laws.
3A. Permitted Use
You may use Noir Cigar™ services only for lawful purposes and in accordance with these Terms, including reading and engaging with cigar review content, recording personal cigar tasting notes through the Detective's Case File application, subscribing to our newsletter, clicking affiliate links, and inquiring about Detective Watson appearances or Noir Event design services.
3B. Prohibited Uses
You agree NOT to: use our services in violation of applicable laws; attempt unauthorized access to our services, servers, or databases; reproduce or resell any portion of our content or services without express written permission; submit false or fraudulent information; use automated tools, bots, or scrapers to interact with our services; attempt to reverse engineer or extract source code from our applications; transmit spam or malicious code; impersonate any person or entity, including Detective Watson or AC Creative Inc.; or harvest personal information about other users without their consent.
To use the Detective's Case File application, you must create an account. You are responsible for providing accurate information during registration, maintaining the confidentiality of your login credentials, all activity that occurs under your account, and notifying us immediately at info@noircigar.com if you suspect unauthorized access.
Upon account termination — whether by you or by us — your right to access the application ceases immediately. You may request a data export prior to account deletion by contacting info@noircigar.com.
By using our services, you acknowledge that we collect certain personal information including name/username, phone numbers, email addresses, and passwords. Your personal information is handled in accordance with our Privacy Policy, incorporated into these Terms by reference.
5A. Tracking Technologies: Our website and application use cookies, web beacons, local storage, and sessions for analytics, session management, and remarketing purposes.
5B. Advertising & Remarketing: Our website may use retargeting services including Google Ads and the Facebook Pixel to display relevant Noir Cigar™ advertisements to you on other websites after you visit noircigar.com. You may opt out of personalized advertising through Google at adssettings.google.com, Facebook at facebook.com/ads/preferences, or the Digital Advertising Alliance at aboutads.info/choices.
5C. Device & System Permissions (App): The Detective's Case File application may request camera access (to photograph cigar bands) and photo gallery access (to upload existing photos). These permissions are optional and do not affect core app functionality if denied.
6A. Your Content: You retain ownership of the personal tasting notes, observations, photographs, and content you create within the Detective's Case File application. By submitting User Content, you grant AC Creative, Inc. a non-exclusive, royalty-free, worldwide license to store and display your User Content within the application for your personal use, and to use anonymized, aggregated versions of your tasting data for industry research as described in the Privacy Policy.
6B. Our Intellectual Property: All content, features, and functionality on noircigar.com and journal.noircigar.com — including text, images, videos, graphics, logos, the Trench Coat Rating System™, the Knockout Meter™, Case File structure, Dame of the Month concept, the Detective Watson persona, and the Bureau Engine framework — is the exclusive property of AC Creative, Inc. and is protected by U.S. and international intellectual property laws.
The following are trademarks of AC Creative, Inc.: Noir Cigar™, Trench Coat Rating System™, Detective's Case File™, Bureau of Curiosity™. Unauthorized use of any Noir Cigar™ trademarks is strictly prohibited. The Bureau Engine framework is a proprietary system — any unauthorized reproduction, white-labeling, or resale is prohibited and may result in legal action.
By creating an account in the Detective's Case File application, you consent to the collection and commercial use of anonymized, aggregated tasting data as described in our Privacy Policy. This includes the potential licensing of aggregate insights to cigar manufacturers, hospitality partners, and industry researchers. Your personal identity is never included in any data we sell, license, or share. You may withdraw consent and request account deletion at any time by contacting info@noircigar.com.
Noir Cigar™ services may include payment options for merchandise, subscriptions, or premium services. We do not store your payment card information on our servers. Recurring subscriptions will automatically renew unless cancelled before the renewal date. Refund policies for specific products are stated at the point of purchase; general digital content purchases are non-refundable except as required by applicable law. By subscribing to our mailing list or opting in during account registration, you consent to receiving email communications from Noir Cigar™, including newsletters, content updates, and promotional offers. You may unsubscribe at any time by clicking the Unsubscribe link in any email. Transactional emails related to your account are not subject to marketing opt-out.
Noir Cigar™ participates in affiliate marketing programs. Links within our content — particularly in The Detective's Supply Room, The Newsstand, and Case File blog posts — may be affiliate links. When you click an affiliate link and make a purchase, The Agency may earn a commission at no additional cost to you. All affiliate relationships are disclosed at the point of placement in accordance with FTC requirements (16 CFR Part 255).
Inquiries about Detective Watson appearances or Noir Event design services are subject to separate written agreements. These Terms do not constitute a booking confirmation or guarantee of availability. All event and appearance services require a separately executed written service agreement signed by both parties, a non-refundable deposit as specified in the service agreement, and compliance with all applicable local event permits, venue regulations, and tobacco laws at the event location. Noir Cigar™ reserves the right to decline any booking request at its sole discretion.
If you submit a cigar for review through the "Investigate My Cigar" service, you represent and warrant that you have the legal right to submit the product and the cigar has been lawfully obtained. By submitting a cigar for review, you grant Noir Cigar™ a non-exclusive, royalty-free, perpetual license to publish, display, distribute, and repurpose the resulting review content across all Noir Cigar™ platforms. Noir Cigar™ reserves the right to decline any submission at its sole discretion.
Our services integrate with and link to third-party platforms including affiliate retailers, email marketing platforms, merchandise fulfillment services, analytics and advertising services, and application infrastructure providers. Your use of any third-party service is governed by that service's own terms and privacy policy. We are not responsible for the availability, accuracy, content, or privacy practices of any third-party service.
NOIR CIGAR™ SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AC CREATIVE, INC. DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
Cigar reviews and ratings published on Noir Cigar™ represent the subjective opinions of Detective Watson and do not constitute professional tobacconist advice, health guidance, or endorsement of specific products.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AC CREATIVE, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF — OR INABILITY TO USE — OUR SERVICES, OR FROM THE CONDUCT OF ANY THIRD PARTY, INCLUDING AFFILIATE RETAILERS. This limitation applies regardless of the legal theory on which the claim is based, even if we have been advised of the possibility of such damages.
You agree to defend, indemnify, and hold harmless AC Creative, Inc., Noir Cigar™, and their respective officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of our services in any manner not expressly authorized, your User Content, or your violation of any applicable law or third-party right.
These Terms shall be governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Before initiating any formal legal proceeding, the parties agree to attempt informal resolution by contacting us at info@noircigar.com. If informal resolution is unsuccessful, any legal action shall be brought exclusively in the federal or state courts located in Virginia Beach, Virginia. To the extent permitted by applicable law, you agree to resolve disputes on an individual basis only, and not as part of any class, collective, or representative action.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. All remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy and any separate written agreements for specific services, constitute the entire agreement between you and AC Creative, Inc. with respect to your use of our services and supersede all prior and contemporaneous agreements, representations, and understandings.
No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition. Our failure to assert any right or provision under these Terms shall not constitute a waiver of that right or provision.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this document, notify registered app users by email, and post notice of changes on noircigar.com. Your continued use of our services following notice of any changes constitutes your acceptance of the revised Terms.
